This Privacy Policy describes how KIKI Japan LLC d/b/a Giftada (“Giftada,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you use the Giftada website, platform, and services (collectively, the “Service”).

By using the Service, you agree to the collection and use of your information as described in this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms of Service.

1. Information We Collect

1.1 Information You Provide to Us

We collect information you provide directly when you use the Service, including:

• Account information:First name, last name, email address, phone number, and payment information (processed and stored by Stripe; we do not store full credit card numbers).
• Recipient information:Recipient first name, last name, relationship type, gender identity, shipping address, phone number, and gift preferences. All recipient information is provided by you, the account holder. We do not collect information directly from recipients.
• Event and occasion information:Occasion type, date, budget range, and preferred gift type(s).
• Communications:Any messages, feedback, or other content you send to us via email or through the Service.
• Free tier registration:Email address, first name, one date, recipient relationship, and occasion type.

1.2 Information Collected Automatically

When you visit or use the Service, we and our third-party service providers may automatically collect certain information, including:

• Device and browser information:IP address, browser type, operating system, device identifiers, and screen resolution.
• Usage data:Pages viewed, links clicked, time spent on pages, and referring URLs.
• Cookies and similar technologies:We use cookies and similar tracking technologies to operate the Service, analyze usage, and improve your experience. See Section 6 (Cookies and Tracking Technologies) for details.

We may receive limited information from third-party service providers we use to operate the Service, including payment confirmation data from Stripe and address verification results from our address verification provider.

We use the information we collect for the following purposes:

• To provide the Service:Processing your account, curating gifts based on your inputs, placing orders with vendors, coordinating delivery, and managing your subscription.
• To process payments:Charging your annual membership fee and gift order amounts through our payment processor.
• To communicate with you:Sending transactional emails (order confirmations, payment receipts, delivery updates, renewal reminders, account changes) and, where you have not opted out, marketing communications (upgrade prompts, holiday reminders, newsletters).
• To verify addresses:Validating recipient shipping addresses through our address verification provider to reduce delivery failures.
• To improve the Service:Analyzing usage patterns, troubleshooting issues, and developing new features.
• To protect the Service:Detecting and preventing fraud, abuse, and security threats.
• To comply with legal obligations:Responding to lawful requests from law enforcement or government authorities, and meeting tax, regulatory, and record-keeping requirements.

We do not sell your personal information. We do not share your personal information for third-party advertising purposes.

3. How We Share Your Information

We share your information only in the following circumstances:

• With vendors to fulfill gift orders:When we place a gift order on your behalf, we share the minimum recipient information necessary to fulfill and deliver the order. This typically includes the recipient’s name and shipping address, and may include the recipient’s phone number when required by the vendor or carrier for delivery coordination.
• With service providers:We use third-party service providers to help us operate the Service, including payment processing, email delivery, address verification, website hosting, and analytics. These providers access your information only to perform services on our behalf and are contractually obligated to protect it.
• To comply with law:We may disclose your information if required by law, regulation, legal process, or governmental request, including in response to subpoenas, court orders, or other lawful requests from public authorities.
• To protect rights and safety:We may disclose your information when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or respond to a security incident.
• In connection with a business transfer:If Giftada is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

4. Data Retention

We retain your personal information for as long as reasonably necessary to provide the Service to you, fulfill the purposes described in this Privacy Policy, comply with our legal obligations (including tax, accounting, and regulatory requirements), resolve disputes, and enforce our agreements.

When your account is deleted or your data is no longer needed, we will permanently delete or anonymize your personal information within 30 to 90 days, unless retention is required for legal compliance.

Certain records, such as transaction records, consent logs, and dispute documentation, may be retained for longer periods as required by applicable law, payment processor rules, or card network requirements.

5. Your Rights and Choices

5.1 Account Information

If you are a paid tier user, you can review and update your account information at any time through your account dashboard. If you are a free tier user, you can request changes by emailing us at hello@withgiftada.com.

5.2 Data Deletion

Paid tier users can delete their account at any time from the account dashboard. Account deletion is immediate and permanent. All associated data will be permanently deleted or anonymized within 30 to 90 days, unless retention is required for legal compliance. This cannot be undone.

Free tier users can request data deletion by emailing hello@withgiftada.com. We will process your request and permanently delete or anonymize your data within 30 to 90 days, unless retention is required for legal compliance.

5.3 Marketing Communications

You can opt out of marketing communications at any time by using the unsubscribe link in any marketing email or by contacting us at hello@withgiftada.com. Free tier users receive all communications as marketing emails. If you unsubscribe as a free tier user, you will no longer receive any emails from Giftada, including date reminders.

Opting out of marketing communications does not affect transactional communications for paid tier users, which are necessary to provide the Service.

5.4 Cookies

Most web browsers are set to accept cookies by default. You can adjust your browser settings to remove or reject cookies. Note that disabling cookies may affect the functionality of certain parts of the Service. See Section 6 for more details.

5.5 California Residents

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), may provide you with additional rights regarding your personal information, including the right to know what personal information we collect and how we use it, the right to request deletion of your personal information, the right to correct inaccurate personal information, and the right to opt out of the sale or sharing of your personal information.

We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.

5.6 Other State Privacy Rights

6. Cookies and Tracking Technologies

We use cookies and similar technologies on the Service for the following purposes:

• Essential cookies:These are necessary for the Service to function, including session management, authentication, and security.
• Analytics cookies:We use Google Analytics (GA4) to understand how visitors interact with the Service. GA4 collects usage data such as pages viewed, session duration, and general location (city/region level). GA4 uses cookies and collects IP addresses, which Google may truncate before storage. Google’s privacy policy governs its processing of this data.
• Marketing and automation cookies: We use Klaviyo to deliver email marketing and reminder communications. Klaviyo's onsite tracking collects usage data such as pages viewed and forms submitted, and uses cookies to support email automation and personalization. Klaviyo's privacy policy governs its processing of this data.

You can control cookie behavior through your browser settings. Most browsers allow you to block or delete cookies. However, blocking essential cookies may prevent parts of the Service from functioning properly.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encrypted data transmission (HTTPS), secure payment processing through Stripe (PCI-DSS compliant), and access controls limiting who can view your data.

No method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.

8. Third-Party Services

The Service relies on third-party service providers to operate. These providers may have access to your personal information only to perform specific tasks on our behalf and are obligated to protect it. Our key service providers include:

• Payment processing:Stripe processes and stores your payment information. We do not have access to your full credit card number. Stripe’s privacy policy governs their handling of your payment data.
• Email delivery:Klaviyo sends transactional and marketing emails on our behalf.
• Address verification:Lob verifies recipient shipping addresses.
• Website hosting: Softr hosts the website and client portal.
• Analytics:Google Analytics collects and processes usage data.
• Database: Airtable stores and manages customer, recipient, event, and order data.
• Automation: Make.com processes and routes data between our service providers to operate automated workflows.

Each of these providers has its own privacy policy governing their use of your data. We encourage you to review them.

9. Children’s Privacy

The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected personal information from a child under 13, we will take steps to delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us at hello@withgiftada.com.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the updated Privacy Policy constitutes your acceptance of the changes. If you do not agree to the updated Privacy Policy, you may delete your account before the changes take effect.
